TCS Program 2007-03:

Introduction

In accordance with Presidential Decree (Keppres) article No. 13/2006 dated September 8th, 2006 and Presidential Regulation (Perpres) article No. 14/2007 dated April 8th, 2007, the amends for the mudflow victims has decided and PT Lapindo Brantas Inc. has to pay the amends in purchase-sell scheme in two steps of payment. The first 20%, as the down payment, and the rest of 80% should be paid latest one month before the end of the lease contract.

 

Practically, the payment of the amends runs slowly. The first payment can only be executed in March 26th, 2007 or 4 months after the deal in December, 4th 2006. Based on the TCS records, the realization of the first payment or the down payment up to mid of June 2006 was only 175 land area or around 27,8 hectares owned by 79 family as the part of resident from 4 villages, i.e. Mindi, Siring, Jatirejo and Kedungbendo.

The Residents are not only facing the longer payment problems, they are also facing the change of cultures as they have to move and relocate to a new place which will have a different culture comparing to their original places.


The Objective of the Assistance Program

The main objective of the program is to assist the residents beginning from the settlement of agreement among them regarding the expected spatial arrangement of the new relocation place until the implementation of participation relocation process.

The agreement will delivered to the Lapindo and Sidoarjo Mudflow Mitigation Agency (BPLS) to be followed up through the discussion process with the involvement of all parties, including the residents, the company, BPLS and the Local Government of Sidoarjo Regency. The points to be agreed by all the parties are as follows :

  1. In what way the conversion of the amends to the relocation scheme can be done? (The Residents with BPLS and the Company).
  2. To what area the victims will be relocated? (The Residents with Local Government and the Company).
  3. In what way the Residents can be involved in construction process at the relocation area? (The Residents with BPLS and the Company).
  4. What kind activities can be done together before the relocation area is ready? (The Residents with BPLS and the Company).


Scope of Work

The Scope of Work of the Assistance Programe specified by the number of families (households) willing to relocate together in accordance with the original place and the smallest unit is Rukun Warga (Residential Unit) .

The partner who will finance the program can decides by themselves the Residents to be aid and TCS will appointed the local counterpart to assist them. TCS will arrange the mapping of the assistance program to avoid the unnecessary overlapping assistance.


Performance Measurement

The Performance of the program specified by the following indicators:

  1. The achievement of written agreement regarding the expected spatial arrangement of the new relocation place.
  2. The achievement of agreement among the Residents and BPLS and the Company regarding the conversion of the amends to the relocation form.
  3. The achievement of Principal Permit of relocation area from local government of Sidoarjo Regency.
  4. The achievement of agreement regarding the victims involvement in construction process at relocation area from BPLS and the Company.
  5. The achievement of agreement regarding the activities should be done by the Residents during the construction process at relocation among the involved parties (the Residents, the Local Government, the Company and BPLS).
  6. Relocation of the Residents to the new area can be implemented according to the agreements made.

 

Current Situation

For the time being, our local counterparts are assisting around 500 families (households) originated from Renokenongo village. They asked for the assistance of preparing administration requirements needed for the 20% amends.
