TCS Program 2007-02 Introduction In accordance with Presidential Decree (Keppres) article No. 13/2006 dated September 8th, 2006 and Presidential Regulation (Perpres) article No. 14/2007 dated April 8th, 2007, the amends for the mudflow victims has decided and PT Lapindo Brantas has to pay the amends in purchase-sell scheme in two steps of payment. The first 20%, as the down payment, and the rest of 80% should be paid latest one month before the end of the contract. Practically, the payment of the amends runs slowly. The first payment can only be executed in March 26th, 2007 or 4 months after the deal in December, 4th 2006. Based on the TCS records, the realization of the first payment or the down payment up to mid of June 2006 was only 175 land area or around 27,8 hectares owned by 79 families as the part of residents from 4 villages, i.e. Mindi, Siring, Jatirejo and Kedungbendo. One of the constraints of the amends payment was the difficulties of the victims to prepare the administration requirement. The constraint came out from the lack of understanding of the peoples and the country institution regarding the important of correct administration of the land ownership before the disaster happened, and this lead to a complicated situation in preparing the documentations needed for the amends. In the other side, the historical records of the land ownership were not correctly recorded that cause to occur the potential conflicts among the victims. Based on the TCS fact finding in the field, there are a lot of land ownership transferring or heir without completed by a legal documents. Some of them not even have a legal documents for their land ownership.
The Objective The main objective of the Assistance Program is to assist the victims to solve the problems mentioned above and categorized them by the problems and the related conflicts to achieve the written agreement with sincere through the discussion and negotiation. The Scope of Work The Scope of Work of the Assistance Program specified by the number of families or victims which has land ownership problem and categorized by the kind of problems and related conflict. The partner who will finance the program can decides by them selves the victims to be aid and TCS will appointed the local counterpart to assist the victims. TCS will arrange the mapping of the assistance program to avoid the unnecessary overlapping assistance.
The Performance Measurement Performance of the program measured by the percentage of the victims family succeed to have the written agreement compared to the total number of the victims to be assisted in a certain period.
The Current Situation For the time being, our local counterparts are assisting around 500 victims family originated from Renokenongo village. They asked for the assistance of preparing administration requirements needed for the 20% amends. There are a lot of victims have potentially conflict among them caused by incorrect historical record of ownership transferring before the disaster happened.
